FRENCH IMMIGRATION LAW

French immigration law deals with the entry and stay on French territory of persons who do not have French nationality. Immigration law is a remarkably complex, evolving and technical matter that requires great rigor and responsiveness.

Entry into france :

  • Application for a short-stay visa (this is a tourist or travel visa issued for a stay of less than three months).
  • Application for a long-stay visa (issued for a stay of more than three months).

Please note :

  • that several types of short-stay visas exist. The uniform short-stay visa, called”Schengen visa”, is issued under the Community Code on Visas and allows the beneficiary to move freely within the Schengen Area for a maximum period of three months or for the period of validity of the visa, which is usually shorter.
  • that unlike a short-stay visa, a long-stay visa is an establishment visa that allows the holder to stay in France only. It allows the foreigner to apply for a residence permit once he/she has arrived in the French Republic.
  • Appeals against the refusal to issue a visa: referral to the Commission of Appeal against Visa Refusal (CRRV), hierarchical appeal and appeal to the administrative court of Nantes.
  • Refusal of entry into French territory.

Professional immigration :

  • Application for a work permit with or without opposability of the employment situation; than three months).
  • Application for a temporary residence permit mentioning employee (worker on permanent contract).
  • Application for a temporary residence permit mentioning temporary worker (worker on a fixed-term contract).
    • Application for a multi-year residence card mentioning Talent Passport: This is a multi-year residence card, valid for up to 4 years (and renewable), issued in several situations, in particular if you are :

    • a highly qualified employee, or.
    • a qualified employee with a French professional degree or master’s equivalent, or.

  • Application for a multiannual residence permit mentioning seasonal worker.
  • Application for a multiannual residence card mentioning a seconded ICT employee.
  • Application for a temporary residence permit mentioning job search or business creation.
  • For self-employed workers: application for a residence permit mentioning entrepreneur/independent worker, Passeport Talent etc.
  • Admission exceptionnelle au séjour par le travail/régularisation.
  • Exceptional admission to residence through work/regularization.
  • Change of status.

Family immigration :

  • Family reunification procedure.
  • Marriage, Pacs and the legal situation of foreigners who are spouses of French nationals.
  • Family members of European Union nationals.
  • Issuance of the “private and family life” residence permit (which is equivalent to a work permit).
  • Application for a “retiree”card.
  • Exceptional admission to the residence permit for humanitarian or exceptional reasons.

Private or tourist stay :

  • Application for a Schengen visa.
  • Application for a long-stay visa valid for a residence permit mentioning visitor.

French nationality :

  • Acquisition of French nationality by declaration.
  • Naturalization and reintegration by decree.

Litigation :

  • Appeals against decisions to refuse the issuance or renewal of residence permits: appeals to the prefect, hierarchical appeals to the Minister of the Interior, or contentious appeals to the administrative court with territorial jurisdiction.
  • Contesting deportation measures (obligation to leave French territory, A.R.F., deportation order, ban from French territory).
  • Litigation in the field of nationality law: administrative and contentious appeals.

Right of asylum :

  • Appeal against the decision of OFPRA before the National Court of Asylum (CNDA).
